Copyright Policy

1. Overview

enc0re, Inc. ("enc0re," "we," "us," or "our") respects the intellectual property rights of others and expects users of the enc0re™ mobile application and related services (the "Service") to do the same. This Copyright Policy describes our procedures for responding to allegations of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the "DMCA").

If you believe that content available on or through the Service infringes your copyright, please submit a notification as described below. Upon receipt of a valid notification, we will respond by removing or disabling access to the allegedly infringing material and taking reasonable steps to contact the party that posted it.

2. Filing a DMCA Takedown Notice

If you are a copyright owner or authorized to act on behalf of one, you may submit a written takedown notice to our designated copyright agent. Your notice must include the following:

  • • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • • Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
  • • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Service (such as a URL, username, or description of where the content appears).
  • • Your contact information, including your name, mailing address, telephone number, and email address.
  • • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

3. Counter-Notification Procedure

If you believe that material you posted on the Service was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our designated copyright agent. Your counter-notification must include the following:

  • • Your physical or electronic signature.
  • • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  • • A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • • Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, the United States District Court for the Central District of California), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the party that filed the original takedown notice. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days of receiving the counter-notification, we may restore the removed material at our discretion.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, enc0re has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.
